Please read these Terms of Service ("Terms") carefully before using the TNTH HOUSE website or purchasing any products. By accessing our website or completing a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

 

1. About TNTH HOUSE

TNTH HOUSE is a Canadian digital design studio offering digital products, including email marketing templates, social media content templates, launch assets, marketing frameworks, and similar tools (collectively, "Products"). Our Products are designed to help businesses execute their marketing with clarity and confidence.

These Terms govern your access to and use of our website located at https://wearetnth.com and any Products you purchase from us.

 

2. Eligibility

By using our website or purchasing our Products, you represent that:

•       You are at least 18 years of age (or the age of majority in your jurisdiction)

•       You have the legal capacity to enter into a binding agreement

•       You are not prohibited from using our services under any applicable law

 

3. Digital Products & Delivery

3.1 Nature of Products

All Products sold by TNTH HOUSE are digital downloads or template files delivered electronically. No physical goods will be shipped. Upon completing your purchase, you will receive access to your Product(s) via a download link or through the platform used to deliver your order.

 

3.2 Delivery

Digital products are typically delivered immediately or within a few minutes of purchase confirmation. We are not responsible for unforeseeable internet outages or delays in delivery outside of our control. Platform compatibility requirements are listed on each individual product page, and it is the customer's responsibility to confirm compatibility prior to purchase — please refer to Section 5 (Refund Policy) for how this applies. If you do not receive your download link within 24 hours, please contact us at hello@wearetnth.com with your order details and we will work to resolve the issue promptly.

 

3.3 Compatibility

It is your responsibility to ensure that your devices, software, and accounts are compatible with our Products before purchasing. TNTH HOUSE Products may require access to third-party platforms such as Canva, Adobe, Notion, Flodesk, or similar tools. We are not responsible for any third-party platform's availability, pricing changes, or feature updates that may affect your use of our Products.

 

4. Pricing & Payment

All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Prices may be displayed in local currency for reference purposes, but all transactions are processed in CAD. We reserve the right to change pricing at any time without notice. Price changes will not affect orders already completed.

Payments are processed securely through our third-party payment processor(s). TNTH HOUSE does not store your payment card information. By completing a purchase, you agree to the payment processor's terms and conditions.

You are responsible for any applicable taxes, conversion fees, duties, or any sort of fees in your jurisdiction. TNTH HOUSE will collect and remit applicable Canadian taxes (e.g., GST/HST) as required by law.

 

5. Refund Policy

5.1 No Refunds on Digital Products

Due to the immediate and irrevocable nature of digital product delivery, all sales are final. We do not offer refunds, exchanges, or cancellations once a digital product has been delivered or a download link has been issued.

 

5.2 Exceptions

We may, at our sole discretion, consider a store credit in the following exceptional circumstances:

  • You were charged more than once for the same order due to a technical error

  • The Product file is corrupted, incomplete, or materially different from its description, and we are unable to resolve the issue within 5 business days

To request an exception, contact us at hello@wearetnth.com within 2 business days of purchase with your order details and a description of the issue. Requests submitted after this window will not be considered.

 

5.3 Chargebacks

If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to dispute the chargeback, provide evidence of delivery, and permanently revoke your access to TNTH HOUSE Products and services.

 

6. Intellectual Property & Licence

6.1 Ownership

All TNTH HOUSE Products, including but not limited to template designs, copy frameworks, email flows, graphics, and written materials, are the exclusive intellectual property of TNTH HOUSE and are protected by Canadian and international copyright law.

 

6.2 Licence Grant

Upon purchase, TNTH HOUSE grants you a limited, non-exclusive, non-transferable, personal licence to use the purchased Product(s) for your own business or personal use. This licence allows you to:

  • Customize and edit the templates for use within your own brand or business

  • Use the finished, customized output in your marketing materials or business operations

  • Each licence is valid for a single business entity only; use across multiple businesses or brands requires a separate purchase per entity

 

6.3 Restrictions

You may NOT, under any circumstances:

•       Resell, redistribute, sublicense, or share the original template files — whether free or for profit

•       Claim authorship or ownership of the original TNTH HOUSE designs or frameworks

•       Use our Products to create competing template products, courses, or resources

•       Share download links, files, or access credentials with others who have not purchased

•       Upload or post the original (unedited) template files to any public platform or marketplace

Violation of these restrictions may result in termination of your licence and legal action to recover damages.

 

6.4 Client Work

If you are a designer, strategist, or creative professional using TNTH HOUSE Products on behalf of clients, you may customize our templates as a structural foundation for client deliverables. However, the following conditions apply:

  • All template assets, copy, imagery, branding, and supporting materials must be replaced or supplied independently by the buyer — TNTH HOUSE does not provide stock imagery, licensed graphics, or any third-party assets for client use

  • You may not resell, share, or transfer the original template files to your clients or any third party

  • TNTH HOUSE assumes no responsibility for the end deliverable produced for your client, including its performance, accuracy, or compliance with any applicable regulations

  • End deliverables (e.g., a finished email sequence or social media graphic) are permitted; raw or minimally edited template files are not

 

7. Prohibited Use

You agree not to use our website or Products to:

•       Violate any applicable local, provincial, national, or international law or regulation

•       Infringe upon the intellectual property rights of TNTH HOUSE or any third party

•       Transmit unsolicited commercial communications (spam)

•       Engage in fraudulent, deceptive, or misleading conduct

•       Attempt to gain unauthorized access to our systems or data

•       Use our Products in connection with any illegal, harmful, or offensive activity

We reserve the right to refuse service, cancel orders, or revoke access at our discretion if we believe these Terms are being violated.

 

8. Disclaimers

8.1 No Guarantee of Results

TNTH HOUSE Products are tools designed to support your marketing efforts. We do not guarantee any specific business results, revenue outcomes, conversion rates, or growth from the use of our Products. Results depend on many factors outside our control, including your implementation, audience, market conditions, and platform algorithms.

 

8.2 "As Is" Delivery

Our Products are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Products will meet every specific business need or that they will be error-free. Descriptions and previews are provided for illustrative purposes and minor variations may exist.

 

8.3 Third-Party Platforms

TNTH HOUSE is not affiliated with, endorsed by, or responsible for any third-party platforms referenced in or required to use our Products (e.g., Canva, Flodesk, Shopify, Instagram). Any changes to those platforms that affect your use of our Products are outside our control and do not entitle you to a refund.

 

9. Limitation of Liability

To the fullest extent permitted by applicable law, TNTH HOUSE, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or Products, including but not limited to:

  • Loss of profits, revenue, or business opportunities

  • Loss of data or business information

  • Damage to your brand, reputation, or relationships

  • Technical issues with third-party platforms used alongside our Products

  • Any errors, omissions, or inaccuracies in customized content produced using our templates

  • Any claims made by your clients or third parties arising from your use of our Products

By completing a purchase, you acknowledge that you have independently evaluated our Products and have not relied solely on any representation, description, or marketing material made by TNTH HOUSE in making your purchasing decision. You accept full responsibility for how our Products are used, customized, and deployed — whether for your own business or on behalf of clients.

You further acknowledge that the use of marketing templates and digital tools carries inherent risk, including but not limited to variable performance outcomes, platform dependency, and audience response. TNTH HOUSE makes no guarantee that our Products will produce any specific result, and you assume all risk associated with their use.

In any event, TNTH HOUSE's total aggregate liability to you shall not exceed the amount you paid for the specific Product giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, negligence, or otherwise, and even if TNTH HOUSE has been advised of the possibility of such damages.

 

10. Indemnification

You agree to indemnify, defend, and hold harmless TNTH HOUSE and its owners, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of our Products or website; (b) your violation of these Terms; or (c) your infringement of any third-party rights.

 

11. International Use

TNTH HOUSE is based in Canada and our Products are available for purchase internationally. By accessing our website from outside Canada, you are responsible for compliance with your local laws. We make no representation that our Products or website are appropriate or available for use in all locations.

International customers are responsible for any applicable customs duties, import taxes, or local compliance requirements. Prices may be displayed in CAD; currency conversion is handled by your bank or payment provider. We are not responsible for conversion fees and the like.

 

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or Products after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

For material changes, we may notify you via email if you are a registered customer.

 

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Products shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Ontario, Canada, in accordance with the applicable arbitration rules, unless prohibited by your local consumer protection laws.

Nothing in this section limits your rights as a consumer under applicable mandatory local law.
